Fox: GOA Secures Victory in Federal Court Against New York

A federal judge on Monday blocked parts of New York’s controversial gun law that restricts concealed carry rights in certain areas of the state while a Second Amendment advocacy group challenges the law on constitutional grounds.

District Court Judge Glenn Suddaby said the law invoked “unprecedented constitutional violations” and granted a partial preliminary injunction in favor of Gun Owners of America (GOA), forcing the state to immediately cease enforcement of parts of the law, which was signed by Gov. Kathy Hochul in July.

“We are excited to see Kathy Hochul finally served a plate of humble pie, and we are fully prepared to continue the fight should she again attempt to disarm the citizens of her state at a time when her party’s policies are only escalating the danger that everyday citizens face,” said Erich Pratt, GOA senior vice president…

GOA’s lawsuit comes after the Supreme Court earlier this year in the landmark case New York State Rifle & Pistol Association Inc. v. Bruen ruled that a state law requiring citizens to show “proper cause” for self-defense to obtain a concealed carry permit was unconstitutional, which reset the standard for analyzing Second Amendment challenges.

A federal judge in New York temporarily suspended many parts of the state’s new gun restrictions on Monday to allow members of a gun-owners’ rights group to continue their lawsuit challenging the new law as unconstitutional.

Judge Glenn Suddaby of the U.S. District Court in Syracuse agreed to issue the order at the request of six New York residents who are members of Gun Owners of America, which competes with the National Rifle Association in political influence…

Erich Pratt, Gun Owners of America’s senior vice president, applauded the ruling in a statement, warning Hochul and other politicians to obey the Supreme Court: “fall in line, or we will force you to.”

A federal judge for a second time declared multiple portions of New York’s new gun law unconstitutional, including rules that restrict carrying firearms in public parks and places of worship.

The preliminary injunction Monday from U.S. District Judge Glenn Suddaby is legal setback for Gov. Kathy Hochul and state lawmakers, who quickly rewrote handgun licensing laws after the old ones were struck down by the U.S. Supreme Court in June.

Suddaby halted the state police and local officials named in the lawsuit from enforcing some provisions of the law. That includes stopping people from carrying concealed weapons in certain “sensitive locations,” such as theaters and places where alcohol is served…

This lawsuit is being led by Gun Owners of America and was bought by six gun owners from upstate New York who claim the law infringes on their constitutional rights.

The suit names the head of the state police and local officials from Albany, Greene, Onondaga and Oswego counties.
